Will Adani try Kenya’s airport business again after the new developments?

Towards the end of 2024, Kenya canceled some mega deals entered into with the Adani group. One of the greatest strengths for the cancellation was Adani’s indictment by the US for massive bribery of Indian government officials. Now, the US seems to be letting Adani loose.

Gautam Adani has had an ongoing case in the US since 2024, involving bribery. For his Indian energy company to succeed, he was going to find businesspeople in the US to invest in it.

Meanwhile, he was allegedly bribing some key people in the Indian government for the same end. A US court indicted him for having spent $250 million in the bribery scandal.

On their part, it is said that Indian officials helped Adani’s company, Adani Green Energy, secure highly profitable solar energy projects. These projects were projected to earn Adani’s company more than $2 billion.

Alongside Adani, his nephew, Sagar Adani, was mentioned for the company’s fraudulent activities. He is one of the top company executives.

Things Seem to be Turning Around in Adani’s Favor

The US cases have been working against Adani since 2024. Because of them, it has become difficult for his company to make serious capital investments worldwide.

However, the US administration seems to be handing Adani a lifeline. Apparently, the US Department of Justice (DOJ) is going to drop all the cases against Adani, following agreements with the US state complainants.

The various government entities that have filed complaints against Adani have agreed to accept monetary settlements. One of them, the Foreign Assets Control, has agreed to accept $18 million from Adani as a settlement.

The Securities and Exchange Commission, which also has an issue with Adani’s dealings in Iranian oil, has agreed to accept $275 million in exchange for clearing Adani.

In this agreement between the Adani Group and the US courts, it is said that Adani is neither admitting guilt nor is the US outright pronouncing him innocent.

Why has the US accepted Monetary Settlements?

It is not clear why the US has decided not to proceed with the Adani court cases. It is not clear why the US could not wait for Adani to prove his innocence.

However, informally, it is said that Adani has committed himself to investing $10 billion in the US.

Courts within and outside the US sometimes make interesting judgments. For instance, in mid-2024, a court in Manhattan, US, found US President Donald Trump criminally guilty on 34 counts.

Yet it set him free without a fine or a jail sentence. Moreover, the court released him without any conditions whatsoever.

Adani’s Blocked Business Opportunities

The question now is whether Adani will resume pursuing the business opportunities he has lost since 2024, due to his US indictment. Is he, for instance, going to pursue Kenya, with a view to securing management of the Jomo Kenyatta International Airport (JKIA)?

Previously, it was reported that Adani, through his company, wanted to invest $2 billion to overhaul JKIA.

In exchange, he was to assume the functions currently performed by the Kenya Airports Authority (KAA) for 30 years. Essentially, therefore, the operations at JKIA would be controlled by the Adani Group.

Recently, there was a problem in India when Adani made a unilateral decision to shift FedEx operations. He controls more than 30 international airports in India.

Adani Airport Holdings Limited (AAHL) directed FedEx to relocate its carrier functions from Mumbai Airport to a new airport, Navi Mumbai International Airport (NMIA). Not only did FedEx find that directive an inconvenience, but it was also an unanticipated business risk.

The US Department of Transportation (DOT) ultimately took up the matter. Eventually, it escalated to the desk of the Indian Prime Minister, Narendra Modi. For now, it is a success for the Adani Group, with the US court cases not marring its reputation.
